These Terms of Service ("Terms") govern your access to and use of HumanPen (the "Service"), a document-processing tool available at humanpen.net and operated by the HumanPen team ("HumanPen", "we", "us", or "our"). By creating an account or using the Service, you agree to these Terms. If you do not agree, do not use the Service.
Please read these Terms together with our Privacy Policy, which explains how we handle your personal data. The Privacy Policy is incorporated into these Terms by reference.
1. Definitions
In these Terms:
- "Service" means the HumanPen website, application, and related features made available at humanpen.net.
- "Input" means the documents, text, and passages you submit to the Service for processing.
- "Output" means the results the Service returns to you based on your Input.
- "Credits" means the prepaid units you buy and spend to run jobs on the Service.
- "AI Provider" means a third-party artificial-intelligence model provider that processes your Input to generate Output.
2. The Service
HumanPen is a document-processing tool that helps you improve and transform written documents, while aiming to preserve your original meaning and formatting. The specific features available may change over time.
The Service uses third-party AI Providers to process the text you submit. Output is generated automatically and may contain errors, omissions, or inaccuracies. You are responsible for reviewing and verifying any Output before relying on or distributing it.
We may add, change, or discontinue features of the Service. We will not make changes that materially reduce credits you have already purchased without a reasonable alternative or refund of the affected credits.
3. Eligibility and accounts
You must be at least 16 years old, or the age of digital consent in your jurisdiction, to use the Service. If you use the Service on behalf of an organization, you represent that you are authorized to accept these Terms for it, in which case "you" refers to that organization.
You are responsible for the activity that occurs under your account and for keeping your login credentials secure. Notify us promptly at support@humanpen.net of any unauthorized use of your account.
4. Credits, pricing and payment
The Service is provided on a prepaid credit basis. You purchase Credits in packages, and Credits are consumed when you run a job. The number of Credits a job costs is shown before you confirm it.
Payments are processed by our third-party payment provider, which acts as the merchant of record for your purchase. Prices are shown at checkout and are charged in the currency indicated; you are responsible for any applicable taxes not stated at checkout. Credits purchased directly do not expire. Credits granted as part of any promotion or plan may carry an expiry, which will be shown at the time they are granted.
We may change package prices from time to time. Price changes do not affect Credits you have already purchased.
5. Refunds and cancellation
Because Credits are a prepaid digital product that is consumed when you run a job, the following applies:
- Unused credits: if you have not used any of the Credits from a purchase, you may request a full refund of that purchase within 14 days of the transaction; the corresponding Credits are then removed from your account.
- Partially used credits: once some Credits from a purchase have been used, that purchase is generally non-refundable, because the digital service has been delivered for the portion used.
- Service faults: if a job fails due to a fault on our side, the Credits reserved for it are automatically returned and you are not charged. If you were charged for a job that produced no usable result due to a technical fault, contact us and we will issue Credits or a refund as appropriate.
- Result dissatisfaction: because Output is generated automatically, dissatisfaction with the wording or style of an otherwise-working result is not by itself grounds for a refund; you can re-run a job with different options.
To request a refund, email support@humanpen.net with your account email and, if available, the order number. Refunds are issued through our payment provider to the original payment method. If you believe a charge is incorrect, please contact us before filing a card dispute. This policy does not limit any rights you have under the consumer-protection laws that apply to you.
6. Acceptable use
You may use the Service only for lawful purposes. You are solely responsible for how you use the documents and Output it produces, and for complying with the rules of any school, university, employer, journal, publisher, or other institution that applies to you. Many institutions have specific policies about the use of writing and AI tools in assessed or published work; it is your responsibility to know and follow them.
You may not use the Service, and may not permit anyone else to use it, to:
- Commit academic dishonesty — including submitting work as your own where the substance of an assessment is required to be your independent work, or where your institution prohibits the use of such tools.
- Misrepresent authorship, or pass off content in a way that deceives in violation of applicable rules or law.
- Edit or rewrite content you do not have the right to use.
- Create or spread unlawful, defamatory, harassing, hateful, or infringing content, malware, or content that sexually exploits minors.
- Scrape, crawl, or use bots or other automated means to access the Service, except as we expressly permit; or resell, sublicense, or provide the Service to third parties as your own.
- Circumvent, disable, or interfere with usage limits, credit metering, billing, rate limits, or any security or access control of the Service.
- Use the Output to develop, train, or improve any competing artificial-intelligence model or product.
- Attempt to disrupt, overload, reverse-engineer, decompile, or gain unauthorized access to the Service or its systems.
HumanPen does not authorize or endorse cheating. We provide a tool for improving writing; using it to violate your institution’s rules is a misuse of the Service and your own responsibility. We do not promise that Output will achieve, avoid, or influence any result from any AI-detection, plagiarism, or similar tool.
7. Your content
You retain all rights to the documents you submit ("Input") and to the results the Service returns ("Output"). We do not claim ownership of your Input or Output.
You grant us a limited, non-exclusive, worldwide license to store, process, and transmit your Input and Output solely to operate and provide the Service to you — including sending your Input to the AI Providers that perform the processing, and storing your Input and Output so that you can access your history. This license ends when the relevant content is deleted from the Service, except for copies retained as described in our Privacy Policy.
We do not use your Input or Output to train AI models. We may generate and use aggregated or de-identified statistics about how the Service is used (for example, counts of jobs, word or token volumes, and reliability metrics) to operate, secure, and improve the Service. Such statistics do not identify you and do not include the substance of your Input or Output.
You represent and warrant that you have the necessary rights to the Input you submit and that it does not infringe the rights of any third party or violate any law.
Feedback
If you send us suggestions, ideas, or other feedback about the Service, you agree that we may use it without restriction and without any obligation to you.
8. Third-party services
The Service relies on and may link to third parties, including our authentication provider, payment provider, cloud storage provider, and AI Providers. Your use of those services may be subject to their own terms and privacy policies. We are not responsible for third-party services, and their inclusion does not imply our endorsement.
9. Our intellectual property
The Service, including its software, design, and brand, is owned by HumanPen and protected by intellectual-property laws. These Terms do not grant you any right to our trademarks, logos, or software except the limited right to use the Service as intended. We reserve all rights not expressly granted.
10. Copyright complaints
We respect intellectual-property rights. If you believe content processed through the Service infringes your copyright, contact us at support@humanpen.net with enough detail to identify the work and the allegedly infringing material, your contact information, and a statement that you have a good-faith belief the use is not authorized. We will review and respond to valid notices, and may remove content or suspend accounts of repeat infringers.
11. Disclaimers
The Service is provided "as is" and "as available", without warranties of any kind, whether express or implied, to the fullest extent permitted by law. We do not warrant that the Service will be uninterrupted or error-free, that Output will be accurate or fit for any particular purpose, or that Output will achieve, avoid, or influence any particular result from any AI-detection, plagiarism, or similar tool.
12. Limitation of liability
To the fullest extent permitted by law, HumanPen will not be liable for any indirect, incidental, special, consequential, or punitive damages, or for any loss of data, profits, or goodwill, arising from your use of the Service. Our total liability for any claim relating to the Service will not exceed the amount you paid to us in the three months before the event giving rise to the claim. Some jurisdictions do not allow certain limitations, so some of the above may not apply to you.
13. Indemnification
You agree to indemnify and hold HumanPen harmless from any claims, losses, or expenses (including reasonable legal fees) arising from your Input, your Output, your use of the Service, or your violation of these Terms or applicable law.
14. Suspension and termination
You may stop using the Service at any time. We may suspend or terminate your access if you violate these Terms, or where necessary to protect the Service or comply with the law. If we terminate your account without cause, we will refund any unused Credits. Provisions that by their nature should survive termination — including ownership, disclaimers, limitation of liability, indemnification, and dispute resolution — will survive.
15. Changes to these Terms
We may update these Terms from time to time. When we make material changes, we will update the "Last updated" date above and, where appropriate, notify you. Your continued use of the Service after changes take effect constitutes acceptance of the updated Terms. If you do not agree to the updated Terms, stop using the Service.
16. Dispute resolution
If a dispute arises, please contact us first at support@humanpen.net so we can try to resolve it informally; most concerns can be settled this way. If we cannot resolve it, the dispute will be handled by the courts identified under "Governing law" below, unless mandatory consumer-protection law in your place of residence gives you the right to bring proceedings elsewhere.
17. General terms
- Entire agreement: these Terms and the Privacy Policy are the entire agreement between you and us regarding the Service and supersede any prior agreements on that subject.
- Severability: if any provision is found unenforceable, the remaining provisions stay in effect.
- No waiver: our failure to enforce a provision is not a waiver of our right to enforce it later.
- Assignment: you may not assign these Terms without our consent; we may assign them to an affiliate or in connection with a merger, acquisition, or sale of assets.
- Force majeure: we are not liable for delays or failures caused by events beyond our reasonable control.
18. Governing law and contact
These Terms are governed by the laws of the jurisdiction in which the HumanPen team operates, without regard to conflict-of-laws rules, and subject to any mandatory consumer-protection law that applies to you. Questions about these Terms can be sent to support@humanpen.net.
